About these terms
These terms and conditions apply to all dealings that you, the customer may have with Chile Mojo.
Chile product purchasers:
Purchaser of these products hereby acknowledges the risks associated with use of these products, many of which contain intense heat factors. Purchaser hereby understands and accepts the element of danger if products are misused. Furthermore, it shall be clearly understood that these products are purchased and used strictly at the purchaser's risk. Purchaser hereby releases Chile Mojo from all liability and indemnifies and holds harmless Chile Mojo with respect to any claims of damages or injuries resulting from the use, consumption, ingestion, and/or contact with respect to these products.
If this product is given as a gift the Purchaser will be responsible for making the recipient fully aware of the potential danger if handled improperly, or directly consumed.
Chile Mojo only accepts orders of Hot Sauces with a heat rating higher than 16 from people over the age of eighteen and by accepting these terms you are acknowledging that you are over the age of eighteen.
Placing your order
When you place your order and payment is processed by our billing company we are agreeing to supply you with the goods that you have ordered. At all times Chile Mojo undertakes to maintain a sufficient level of stock to meet all orders.
However, if the item you have ordered is out of stock we will contact you and offer an alternative product, a refund, or that your item may be placed on backorder and shipped when available.
Paying for your order
Chile Mojo offers payments by eWay payment gateway, Paypal and direct deposit.
Shipping options
Chile Mojo offers shipping by Australian Air Express or Australia Post for most parcels under 20kg. Australia Post Parcel Zones are used to calculate regular mail charges. Please contact Australia Post on 131318 if you are unsure of your zone. We also offer satchels as for most products these are a less expensive option and are based on weight only. Occassionally your order may not physically fit due to it's dimensions and we will contact you to offer an alternative shipping option.
Australia Air Express offers package tracking and this is our preferred method of shipping. To date we have not encountered any problems with regular mail, however Chile Mojo is not liable for Australia Post's failure to deliver.
We will, unless otherwise advised, give Authority to Leave your package should you not be available to sign. Please indicate to use if you do not wish us to select this option. Any additional delivery charges incurred will be at the receiver's expense.
As the Chile Mojo retail store is open from Tue-Sat, all online orders will be fulfilled during this time. Orders placed on Saturday thru Monday may experience a delayed shipment.
Returns
If the item or items you have ordered arrives in a damaged condition or is not working then you have the right to return the goods.
Before you return the goods please contact Chile Mojo to advise us of your problem.
Refunds will only be given if we are unable to supply a replacement for the item that has been returned.
Our Liability
We will not be liable for any loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
Our maximum aggregate liability for any Product supplied to you shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.
